Under Florida law it’s a crime to leave the scene of an accident without first stopping to exchange information and provide help if need be.  Any person found leaving the scene of an accident will face misdemeanor or felony charges, depending on the circumstances surrounding the accident.   In general, the penalties for leaving the scene include:

  • Leaving the scene of an accident where property damage occurred: 2nd degree misdemeanor, punishable by up to 60 days in jail and up to $500 in fines.
  • Leaving the scene of an accident where injury occurred: 3rd degree felony, punishable by up to five years in prison and up to $5,000 in fines
  • Leaving the scene of an accident where death occurred: 1st degree felony, punishable by up to 30 years in prison and up to $10,000 in fines.   Vehicular homicide or involuntary manslaughter charges may also be brought against the defendant as well.
