Why Would False Allegations of Domestic Violence Be Made Against You?

Were you recently spoken to by local authorities about domestic violence allegations made against you? Is your significant other on social media explaining to the world how you abused them? Is this all news to you as you know that you never did anything wrong?

If you’re in shock to hear the recent accusations against you, you’re not alone. False domestic violence allegations are, in fact, becoming more common now, than ever thanks to social media.

Because there are many people in the same situation as you each year, we want to explain some of the most common reasons why someone would accuse you of domestic violence and what can be done about it.

Common Reasons For False Allegations

Some of the most common reasons for someone to file false domestic violence allegations include:

  • Child Custody Battles – If you’ve ever gone through a child custody battle, you likely understand how complex they can become. Individuals often do anything they can to get the upper hand on their spouse during child custody battles, which often includes making false domestic violence allegations. Any judge in their right mind would deny custody to a parent charged with domestic abuse. Even if you’re not found guilty, domestic abuse charges can make winning a custody battle a serious uphill battle.
  • Exaggerating the Truth – False allegations can also stem from over-exaggerated versions of the real events. Domestic violence charges are different from other criminal charges, as they do not need to be filed if police see evidence of violence. Meaning you can be charged and convicted of domestic abuse for yelling angrily at your spouse. In your head, you just got into another argument with your significant other. But on the other side of things, your significant other was left feeling as if they were in danger, causing them to reach out to the local police.
  • Spite – Spite is one of, if not the most common reason for false allegations to be made. We often ask our clients to think of any reason the accuser has to spite them. The moment police are made aware of a domestic violence case, they have to act on it. Some states even require the police to make an arrest for domestic violence, even with no concrete evidence. Meaning an ex who hates you could easily just call local authorities and claim that you abused them; which would result in you having to defend your name.
